Grading Security Deposit

In 2007, my wife and I purchased a home from Marydel Homes, Plan 65M-3939, City of Vaughan. Included in the purchase price of the home was a $1,000.00 security grading deposit which is part of the closing costs under Schedule 'H'. In accordance to Schedule 'H', the grading security deposit will be refunded to the purchaser upon municipal assumption of complete subdivision and the refund of the builder's security deposit from the developer. Our subdivision, Upper Thornhill Estates was assumed by the Town of Vaughan in June of 2017. As of six (6) ,months ago, (January 2021) the developer, released all of the collected security deposits to our home builder Marydel Homes through their letter of credit.

It should be noted that Marydel Homes built 100 homes in this subdivision, equaling a total of $100,000.00 in security deposits. According to the Town of Vaughan's municipal assessment office, all other builders in this subdivision have issued refunds to the home owners with the exception of Marydel Homes. All of the criterion from Schedule 'H' have been met and to date no refunds have been issued. I have tried on several occasions via email and phone messages to contact Marydel Homes without success. Marydel Homes is in breach of the of their purchase contract/agreement to all of the homeowners who purchased their homes from this builder. I believe that a reasonable period of time has elapsed for Marydel Homes to refund these deposits.
