Roofer took payment but never delivered on work or refund
On Oct 16th, 2014, I hired A OK Construction (full disclosure - A relative) to replace the roof on our house. We paid $4000 up front with the understanding that work would start within one week of payment. The check was made out to A Ok Construction.
After eight months of being promised that A Ok Constuction would be starting the job soon and then failing show up and start the job, we decided on June 22, 2015, to terminate the agreement and go with another roofer. A OK Construction promised that in early July we should have a refund from him.
After just over four months of promises and delays, while waiting for a full refund and/or schedule of payments, we have finally received an initial payment (eTransfer) of $500 on Oct 30, 2015 from the owner's wife from her personal funds.
Communication broke down after I expressed my concern that this wasn't the full payment when I was under the impression it would be.
We served A Ok Constuction with papers for Small Claims Court on Nov 8, 2015, which A Ok Constuction ignored and the court found A Ok Constuction guilty by default judgment on Dec 1, 2015. The case can be found under Ontario Small Claims Court # SC15000017680000 (along with all supporting material to the case). The money A Ok Construction now owes us is $3620.59. We are in the process of trying to secure the funds owned as there has been no payment or contact since notifying A Ok Constuction of the courts judgment.
I would like A Ok Construction to return the money owed and I'm hoping that my misfortune will at the very least help others with their decisions with working with A Ok Construction in the future.
