Egress window install

Needed an Egress window installed in our new home. Got quotes from several companies.
May 2 2023 - signed confirmed contract with Jonathan (sales rep) and sent a 1300 deposit.
June 14 2023 scheduled installation day. Avni, the lead installer arrived and said he can't do the window, he doesn't have the proper equipment and left. He also told us window is below grade and he doesn't do that.
Jonathan arranged to have a concrete cut professional come to the rescheduled job to do the foundation cut.
June 19th - Avni and crew show up again - manually dug hole and had window cutout made and installed window. Filled hole with stone and dirt. No further drainage was installed to the weeping tile. Inside damage to wall around window, Anvi told us that was our responsibility to repair. (we had 11 windows installed in our old home and never did we have to repair wall damage)
June 27th - lots of rain - river of water came in under window at the baseboards. The window did not leak. Water flowed to lowest point in the basement to the drain in the next room (laundry room) Called Anvi as Jonathan was away. He came over and told us we need to install plastic cover over well. We argued this as we had egress windows and wells at our old house with no issues whatsoever without plastic cover. He installed wood over outside of window with silcone caulking on our siding so it wouldn't leak until Jonathan was able to come to house or have plastic covering installed. Note the well and the dirt around the well were like quicksand.
June 30th, Anvi came to house removed plywood from outside of window and put a new plastic covering over the well. Said that will do it. Nothing else needed.
July 3 - more rain and a worse river of water in our basement. Now we have damaged the wood bed as well as all the baseboard and flooring. Keep in mind the inside of this house is brand new! we purchased this house after it was flipped. Brand new top to bottom. Called Jonathan He said don't know what to tell you, Anvi and him would be there next day to talk to us. We put tarp over window area outside to hopefully prevent any further damage.
We talked to three different contractors as well as our real estate lawyer. ALL Egress windows must be installed with proper drainage piping to the weeping tile.
July 4 - Jonathan and Anvi came to the house. Anvi argued with us that we asked for the window he installed window. We asked him if he installed drainage in the well. He informed us he didn't know what that was. ?? He said he doesn't do that. He installed window and filled with dirt and stone. He got very argumentive and left the house. We talked to John further that day and he said he would look into it further. We showed him all the water damage inside. 8 foot section of drywall; base boards in two rooms; a wood queen size bed; area rug (8 x 10) and possible damage to washer and dryer sitting in water; vinyl flooring in two rooms.
July 6 John let us know a crew would be coming on Monday July 10 to install proper drainage. John stalled some 1 x 6 's and a tarp to keep us water proofed for the weekend.
July 10 Crew showed up started digging and we encountered two large cuts under the window in the foundation exposed to the elements. Jonathan asked Anvi if they were through to the inside and he said YES. We have several witnesses to this conversation. These cuts are a major contributer to the flooding. And the drainage.
The crew had auger was rented, it is not strong enough for the job. One of the installer was flung from the machine. Spoke to Jonathan and he now says that this damage was caused by the crew. He asked me to escalate this to VP Raj Kain for coverage of our damages. He said he was going to get a stronger piece of equipment to do the job properly. They sprayed foam in the cuts and left.
July 16 Professional company from Brampton arrived contracted from Clera - they couldn't believe the damage to the foundation that Clera did. They had it fixed and properly drained in less than 2 hours.
We have had no flooding since.
Now to deal with the company to get our basement fixed. Two rooms with flood damage. Drywall; insulation; baseboards and flooring. All brand new. Not mention the frame the crew from Clera put up around new window. not caulked properly or painted. Tape damage on wall all around the window.
Raj and Jonathan agreed that we need to call our insurance company as they don't do that kind of repair. And we would work out the costs associated with that claim.
Not even 10 minutes later we get an email from Raj saying that Vito the President said they would only cover the damages if they did the work. They were going to send one of their window installers over to assess the damage and put a plan together to repair it. So now the company that couldn't even repair the damage they did when installed the window frame are going to put in new baseboards; drywall and flooring. Right?!
I called Vito to discuss the matter and express my disagreement to this plan. He said and I quote "stop harrassing me" and hung up on me.
We have since gone through our insurance company and repairs have started. We have also had to buy a new bed and area rug for our son's room.
Clera has still not repaired the siding damage they did with the Auger and the silicon caulking to bandaid the problem. It is now 2 months after the install. We have had no compensation from Clera. And they ignore our emails and don't answer the phone. Worst customer service in my lifetime! DO NOT use Clera Windows!
